Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FUR & FABEL website (the “Site”), including all purchases, communications, features, services, and transactions conducted through the Site. The Site is hosted by Shopify Inc., which provides the online e-commerce platform that enables us to offer products and services online. The Site is owned, operated, and managed by STARLAB Brands LLC (“STARLAB Brands LLC,” “FUR & FABEL,” “we,” “us,” or “our”).

By accessing, browsing, using, or purchasing from the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with any additional policies referenced herein, including our Return & Refund Policy, Privacy Policy, Shipping Policy, and any other posted policies or notices. If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to access or use the Site or make purchases through it. By using the Site, you represent and warrant that you meet these requirements and have the legal authority to enter into binding agreements.

1. Shopify Platform and Third-Party Services

Our store is hosted by Shopify. Shopify provides the e-commerce infrastructure used to process transactions and operate portions of the Site. While Shopify provides the technical platform, all products, order fulfillment, customer service, branding, policies, and operational decisions are managed exclusively by STARLAB Brands LLC.

Your use of certain payment methods, financing options, shipping services, or third-party integrations may also be subject to the terms, conditions, and privacy policies of those third parties.

1. Products, Pricing, and Availability

All products, services, pricing, descriptions, promotions, and availability are subject to change at any time without notice. We reserve the right to limit quantities purchased, discontinue products, refuse service, or restrict access to products or services at our sole discretion.

We make reasonable efforts to accurately display product colors, textures, dimensions, finishes, and details. However, actual appearance may vary depending on device settings, lighting, manufacturing variations, monitor calibration, or photography limitations.

Minor differences in color, hardware, stitching, material texture, fragrance profile, packaging, dimensions, or other cosmetic details do not constitute defects.

1. Orders and Payment Authorization

By placing an order through the Site, you represent and warrant that:

• All billing, shipping, and payment information provided is accurate and complete
• You are authorized to use the payment method submitted
• Your purchase and use of the products complies with applicable laws and regulations

We reserve the right to refuse, limit, cancel, or hold any order for any reason, including but not limited to:

• Suspected fraud or unauthorized transactions
• Violations of these Terms
• Pricing or listing errors
• Product availability issues
• Abnormal purchasing activity
• Resale or commercial distribution concerns

If payment has already been processed for a canceled order, we will issue a refund to the original payment method where appropriate.

1. Pre-Orders

Certain products may be offered as pre-orders prior to inventory availability. Estimated shipping or release dates are approximate and subject to change due to production timelines, supply chain conditions, customs delays, transportation disruptions, or other operational factors.

We reserve the right to modify, delay, limit, or cancel pre-orders at any time. If a pre-order cannot be fulfilled, any collected payment for the unavailable item will be refunded to the original payment method.

1. Shipping and Delivery

Shipping timelines are estimates only and are not guaranteed. Once an order is transferred to the shipping carrier, delivery timing and carrier performance are outside of our control.

Risk of loss and title transfer to the customer upon delivery of the order to the shipping carrier. STARLAB Brands LLC is not responsible for shipping delays, lost packages, stolen packages, customs delays, incorrect addresses submitted by the customer, carrier service interruptions, or delivery failures caused by circumstances outside our control.

For international orders, customers are solely responsible for customs duties, taxes, import fees, brokerage fees, regulatory compliance, and destination-country restrictions.

1. Returns and Refunds

All returns, exchanges, store credits, refusals, cancellations, and refunds are governed by our Return & Refund Policy. By placing an order, you acknowledge and agree to the terms outlined in that policy, including return eligibility requirements, inspection standards, condition requirements, and applicable fees.

We reserve the right to deny returns or refunds that do not comply with our policies.

1. Product Use and Pet Safety

FUR & FABEL products are intended for responsible pet use only and must be used under appropriate supervision.

You agree to:

• Supervise your pet while using any carrier, accessory, fragrance, or related product
• Use products only as intended
• Follow all care instructions, sizing recommendations, warnings, and usage guidelines
• Discontinue use if your pet experiences discomfort, irritation, distress, or adverse reactions

Pets vary in temperament, health status, allergies, sensitivities, size, behavior, and tolerance. STARLAB Brands LLC makes no guarantee regarding compatibility with any individual animal.

Our fragrance products are intended for external pet use only. Avoid contact with eyes, nose, mouth, broken skin, or sensitive areas. Discontinue use immediately if irritation occurs.

STARLAB Brands LLC is not responsible for misuse, unsupervised use, improper handling, allergic reactions, injuries, damages, or unintended use of products.

1. Intellectual Property Rights

All Site content and intellectual property associated with FUR & FABEL, including but not limited to:

• Product designs
• Product styling
• Signature accessories
• Packaging concepts
• Website design
• Graphics
• Logos
• Trade dress
• Product photography
• Videos
• Social media content
• Written copy
• Marketing materials
• Branding elements
• Layouts
• Digital assets

are owned exclusively by STARLAB Brands LLC and protected under applicable trademark, copyright, trade dress, patent, and intellectual property laws.

No content from the Site may be copied, reproduced, modified, distributed, republished, sold, scraped, displayed, or used for commercial purposes without prior written consent from STARLAB Brands LLC.

Unauthorized imitation of our designs, visual presentation, branding, or overall commercial appearance is strictly prohibited.

1. User Conduct

You agree not to:

• Use the Site for unlawful, abusive, fraudulent, or misleading purposes
• Attempt to interfere with Site security, infrastructure, or functionality
• Circumvent security features or access restricted systems
• Upload malicious code, spam, bots, or automated scraping tools
• Use false identities or fraudulent payment information
• Impersonate another individual or entity
• Violate intellectual property rights or applicable laws

We reserve the right to suspend or terminate access to the Site for violations of these Terms.

1. Reviews, Submissions, and User Content

Any reviews, comments, photos, videos, suggestions, testimonials, feedback, or other materials submitted to us may be used by STARLAB Brands LLC for marketing, promotional, advertising, social media, product development, or commercial purposes without compensation or further permission, unless prohibited by law.

By submitting content, you represent that:

• You own or control the rights to the content
• The content does not infringe upon third-party rights
• The content is truthful and not misleading

We reserve the right to remove or refuse content at our discretion.

1. Disclaimer of Warranties

The Site and all products and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

To the fullest extent permitted by law, STARLAB Brands LLC disclaims all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Reliability
• Availability
• Compatibility
• Continuous operation

We do not guarantee uninterrupted access to the Site or error-free operation.

1. Limitation of Liability

To the fullest extent permitted by applicable law, STARLAB Brands LLC, its owners, officers, employees, affiliates, contractors, suppliers, licensors, and service providers shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising out of or related to:

• Use of the Site
• Product use or misuse
• Delayed shipments
• Lost profits
• Emotional distress
• Data loss
• Service interruptions
• Third-party actions
• Unauthorized access
• Product dissatisfaction

Our total aggregate liability for any claim shall not exceed the amount actually paid for the specific product giving rise to the claim.

You agree to defend, indemnify, and hold harmless STARLAB Brands LLC and its affiliates, owners, employees, contractors, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, expenses, or attorney’s fees arising from:

• Your use of the Site
• Your violation of these Terms
• Your misuse of products
• Your violation of any law or third-party rights

1. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how information is collected, used, stored, and protected.

1. Governing Law and Jurisdiction

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

1. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

We reserve the right to modify, update, or replace these Terms at any time without prior notice. Changes become effective immediately upon posting to the Site. Continued use of the Site following any updates constitutes acceptance of the revised Terms.
